It’s possible to register a client’s trademark even where there are numerous other, similar marks. The mark might ‘create a unique commercial impression’ for purposes of trademark law. Trademark law protects the public from confusingly similar marks but it doesn’t prevent the proliferation of trite branding.

In this simple visualization, we started with a search in the Federal Trademark Database (US):

  • animal marks using design code 03
  • International Class 045.
  • “legal services” in the Goods and Services Description
  • live marks only

Then we used Google’s Looker to create a simple method for quickly reviewing the visual elements of the marks.

The purpose of a visualization like this one isn’t to determine whether a mark can be registered. This isn’t a clearance report. Instead, it’s a vibe check. So, for demonstration purposes: is that lion mark you’re considering for your law firm really setting your firm apart?
